Conditions of Use


TERMS OF SUPPLY
E Connection Pty Ltd, ABN 94 091 267 364 (E Connection) as the supplier of products including computer hardware, software and components (Products) and related services including installation, maintenance and support (Services) outlined in the proposal/quote document provided, advises that the following terms and conditions will be applicable.


If you (Customer) instruct E Connection to perform any services or supply products, either expressly, by your conduct or by not objecting to these terms and conditions, you will be deemed to have accepted both these terms and conditions and also our Shipping and Returns Policy.


At times E Connection will utilise third parties to supply services on their behalf of E Connection. If this occurs, E Connection will ensure that those supplies will adhere to the same terms and conditions that E Connection does. We will in this case share the necessary information about the project, organisation and components to our third party suppliers.  


PRICING & DELIVERIES
In some cases, E Connection may be unable to source particular products. If this happens, E Connection may provide an alternative option and will advise the customer if any difference in cost. The customer will have the choice to decline the new item and not go ahead with the purchase if they deem the replacement product to be unsatisfactory.

E Connection reserves the right to vary pricing and/or charge any additional costs arising from any variation of the client’s order.


All prices quoted are inclusive of GST. GST at the prevailing rate at the time of supply will have been added to E Connection’s invoices for the supply of products and services under this or any other proposal, quotation, or contract.


If there is a cost for delivery of products, the quote for those products will have a separate item for delivery cost.


LIABILITY FOR DELAY & DAMAGE ON DELIVERY
E Connection shall not be liable for any claim, loss or expense sustained or incurred by any person arising in any way as a result of the unavailability of products or any delay in delivery of the products.  The customer shall examine the products after delivery and E Connection shall not be responsible for any misdelivery, shortage, defect or damage to the products unless the customer notifies E Connection in writing within 24 hours of delivery.

LIABILITY
The customer is to indemnify E Connection against all losses, costs, expenses, demands or liability, whether direct or indirect, arising out of a claim by a third party against E Connection in relation to the provision of services as outlines in E Connection proposal/quotation.

Notwithstanding any other clause in these terms and conditions, E Connection will not be liable for any economical consequential loss or damage of any nature whatsoever.


E Connection shall not be liable for any loss, damage or expenses from any cause beyond its control. This includes equipment breakdowns, failure or abnormal supply of power, act of God, any act default or neglect of the customer or users of the supplied products.


E Connection agrees to take reasonable care and exercise professionalism on all projects, however the customers agrees to indemnify and keep indemnified E Connection against any claim or action whatsoever brought again E Connection, arising directly or indirectly out of or in relation to the products and services supplied.


E Connection will endeavour to outline the key issues to prevent data loss from any information technology use. However, under no circumstances will E Connection be liable for any data or productivity loss caused due by any of supplied services and/or products.

WARRANTY
All products purchased from E Connection are covered by the applicable Supplier’s warranty.  Customer must refer to the warranty details and specified repair period stated on the product or in associated documentation.  E Connection does not provide any warranties in addition to the Supplier’s warranties for that product. E Connection has ensured that each product they supply will have at least a one year Return to Base (RTB) warranty. If a product is found to be faulty, the customer is responsible for determining the faulty product and then returning it to the manafacturer or our head office. Alternatively, E Connection is able to diagnose the problem, and assist in returning the faulty product to the manufacturer. This service is charged as extra support. Whilst at all times E Connection endeavours to help the customer in replacing or repairing faulty equipment in the shortest time frame, we cannot be responsible for delays.


PAYMENT
It is at E Connection’s discretion to ask for a deposit or even the full amount before ordering any products or services. The full balance is always payable on the delivery of products. In relation to services provided by E Connection, terms may be granted to a customer on a case by case basis.

E Connection accepts payment by Cash, Cheque, Direct Deposit or Credit Cards. Purchases from our online store must be paid in full before products are sent. Methods of payment for our online products is from a PayPal account, Credit Card (through PayPal) or Bank Transfer.

SOFTWARE
When software is purchased from E Connection, to the best of our abilities E Connection ensures that the correct licence is purchased for that application. Under no circumstances will E Connection install software for which it cannot verify the licences. If the customer purchases OEM software from us, they realise that they must adhere to the OEM guidelines and purchase hardware to use this software. For some software titles, we are unable to provide the software install CD or DVD, however we can sell and install the licences.


CANCELLATION CHARGES
If E Connection becomes liable to pay a supplier’s cancellation or rescheduling fee due to customer cancelling an order, then E Connection may recover those fees from the customer.

STOCK RETURNS FOR CREDIT
Products can only be returned to E Connection for credit within 7 days from invoice date even if E Connection is at fault. Returned products can only be credited at the value equivalent to the current market value of the products.

Physically Damaged goods are not eligible for return and the product must be unopened and in a re-sellable condition acceptable by E Connection.  Any goods that have been written on or defected by the reseller or their courier will not be eligible for return.

All returns outside the above conditions are subject to a minimum 35% re-stocking fee, if and only if E Connection agrees to accept the return at the discretion of E Connection.  E Connection is under no obligation to accept returns of products from Customers.
